In Charge LLC ("we," "us," or "our") respects your privacy. This policy explains how we collect, use, and share your information when you use our power bank rental kiosks, website, and mobile application (collectively, the "Services").
1. INFORMATION WE COLLECT
We collect information that identifies or can be linked to you ("Personal Data").
Identification & Contact: Name, phone number, and email address (provided during sign-up).
Payment Data: Transactions are processed via Stripe. We do not store your full credit card numbers; we only see the last four digits and transaction history.
Precise Geolocation (Sensitive Data): With your consent, our app collects your GPS location to show you nearby Stations. We also log the location of the Station where you rent and return Batteries.
Usage History: We keep a record of your rental duration, fees paid, and which Station Owners’ hardware you utilized.
2. HOW WE SHARE YOUR DATA
Station Owners: We share your name, phone number, and usage history with the third-party owners of the Stations you use. This allows them to manage their equipment and set pricing.
Service Providers: We may share data with vendors who provide SMS alerts, email marketing, or technical support.
Legal Requirements: We may disclose data if required by Texas or Federal law, or to protect the safety and rights of In Charge LLC.
3. MANDATORY TEXAS DISCLOSURE (SALE OF DATA)
Under the TDPSA, we are required to inform you of our data sale practices.
NOTICE: We may sell your sensitive personal data.
While we do not currently sell your personal data to third-party marketers, we reserve the right to do so in the future. If we do, we will provide you with a clear "Opt-Out" mechanism as required by Texas law.
4. DATA RETENTION & SECURITY
Retention: We retain your Personal Data indefinitely for "return customer" convenience and to maintain accurate rental records, unless you request deletion.
Security: We implement reasonable administrative and technical safeguards to protect your data. However, no electronic transmission is 100% secure.
5. YOUR RIGHTS (TEXAS CONSUMER RIGHTS)
As a resident of Texas, you have the following rights regarding your data:
Right to Access: You may request a copy of the data we have collected about you.
Right to Correct: You may request that we fix inaccuracies in your data.
Right to Delete: You may request that we delete your personal data.
Right to Opt-Out: You have the right to opt-out of the "sale" of your data or its use for targeted advertising.

6. CHILDREN’S PRIVACY
Our Services are intended for users aged 18 and older. We do not knowingly collect data from children under 13. By using our Services, you self-certify that you meet the age requirement.
